The purpose of this privacy policy is to inform Users about how Charlie Solutions collects, processes, and protects their personal data when using its website, SaaS platform, and mobile applications.

The terms used in this document are defined as follows:

  • The User refers to any individual or legal entity using Charlie Solutions' Services.
  • The Services provided by Charlie Solutions are the features made available to Users via the web platform or mobile application, such as equipment management and monitoring, user creation and management, data export, user tutorials, sending emails or alert notifications, and data analysis for reports and statistics. More generally, the Charlie Platform, the Charlie Mobile Application, and the Charlie Connect application. Charlie Solutions Services do not cover specific integrations that are negotiated with the user.
  • The Host is the company that hosts the data at the request of a data controller. Charlie Solutions therefore acts as a processor to make its Services available to Users, who define the purpose and means of processing. Charlie Solutions may also use secondary processors to process data on its behalf.
  • User Data refers to data processed by Charlie Solutions on behalf of Users in connection with the performance of the Services subscribed to.
  • Personal Data refers to information relating to an identified or identifiable natural person.
  • The Parties refer to Charlie Solutions and the User.
  • Equipment refers to the User's equipment that needs to be managed and tracked.
  • Hardware refers to the IoT that enables the Equipment to be managed and tracked.

Privacy Policy

1. Identity and roles of the parties

Charlie Solutions, a simplified joint-stock company with capital of €40,200, registered with the Lille Métropole Trade and Companies Register under number 888 912 722, with its registered office located at 225 rue des Templiers, 59000 Lille, France (hereinafter "Charlie Solutions"), acts:

  • as the data controller for data collected via its website and for commercial or communication purposes,
  • as a subcontractor for data processed via its SaaS platform and applications, on behalf of its customers (data controllers).

2. Account management

  • To use the Services, you must create an online account: When a new User is created, they receive a first login email. This email contains the User's login details and a link to the Charlie platform, where they can enter their secure password. It also contains their customer code for using the Charlie Mobile Application if they have access rights, as defined by their administrator.
  • Users are responsible for the accuracy of the information they provide and undertake to update their information or notify Charlie Solutions without delay of any changes affecting their situation.
  • The User shall take all necessary measures to preserve the confidentiality of access to their account.
  • In the event of fraudulent use of their account, Users undertake to immediately inform Charlie Solutions and to change their access password without delay.
  • All costs resulting from such unauthorized use shall be borne by the Users until Charlie Solutions has been informed by them of such use.
  • Charlie Solutions shall in no event be liable for any material or immaterial damage resulting from the use of the account by a third party, with or without the Users' authorization.
  • Charlie Solutions stores feedback data received through its platform on behalf of Users. The dissemination of this data will continue as long as Users have correctly configured and updated their accounts.
  • Charlie Solutions is committed to protecting the integrity, confidentiality, and administrative, physical, and technical security of Users' personal data.

3. Data collected

The categories of data that may be collected are:

  • Identification data: last name, first name, work email address, phone number, company.
  • Login data: usernames, encrypted passwords, login logs, IP addresses.
  • Usage data: navigation path on the platform, features used, interactions with applications.
  • Technical data: information relating to connected sensors and equipment, location of tracked objects.
  • Billing information: bank details, billing history, payments.
  • Cookies and trackers: technical identifiers, session cookies, audience measurement cookies, and, where applicable, marketing cookies.

4. Terms and Conditions of Use

4.1 Charlie Solutions website

Use of the https://www.charlie-solutions.com website implies full and complete acceptance of the general terms and conditions of use described below. These terms and conditions of use may be modified or supplemented at any time, so users of the https://www.charlie-solutions.com website are invited to consult them regularly. Similarly, the legal notices may be modified at any time: they are nevertheless binding on the user, who is invited to refer to them as often as possible in order to remain informed.

This site is normally accessible to users at all times. However, Charlie Solutions may decide to interrupt access for technical maintenance purposes, in which case it will endeavor to notify users in advance of the dates and times of the intervention.

4.2 Charlie Platform

Charlie Solutions provides the User with access to its Charlie Platform, enabling them to retrieve the data collected by the Equipment leased to them.

The User accesses the Charlie Platform via the URL https://client.charlie-solutions.com with their login and password. As creators of other Users, Users are responsible for the processing of personal data contained in these creations. The User is solely and exclusively responsible for the loss/theft of their login details and any consequences that may result. Any use of the login details is deemed irrefutable, which the User expressly agrees to accept. The User undertakes to notify Charlie Solutions immediately of any theft or breach of confidentiality of the login details.

Access to the Charlie Platform is granted via an access code using an authentication protocol designed by Charlie Solutions to ensure connection security tailored to the needs of the User's organization (encrypted login and password, SSL encryption, restrictive IP connection).

4.3 Charlie Mobile Application

The Charlie Mobile Application is available on Android and Apple stores. Access to the Charlie Mobile Application is granted using the same access code as for the Charlie Platform, with a login, password, and the User's customer code.

4.4 Charlie Connect application

The Charlie Connect app is available on the Android and iOS app stores. Access to the Charlie Connect app is granted by entering the user's customer code. The app runs automatically in the background and is 100% anonymous and secure.

5. Description of services provided

5.1 Charlie Solutions website

The purpose of the website https://www.charlie-solutions.com is to provide information about all of the company's activities.

Charlie Solutions strives to provide information that is as accurate as possible on the https://www.charlie-solutions.com website. However, it cannot be held responsible for omissions, inaccuracies, and deficiencies in updates, whether caused by itself or by third-party partners who provide this information.

All information provided on the https://www.charlie-solutions.com website is for informational purposes only and is subject to change. Furthermore, the information on the https://www.charlie-solutions.com website is not exhaustive. It is provided subject to any changes that may have been made since it was posted online.

5.2 Charlie Platform

The purpose of the Charlie Platform is to provide information on the management and monitoring of equipment fleets. It analyzes and processes data reported by the Charlie traceability system. The features available to Users via the Charlie Platform include equipment management and monitoring, user creation and management, data export, user tutorials, sending emails or alert notifications, and data analysis for reports and statistics.

5.3 Charlie Mobile Application

The Charlie Mobile Application is designed to provide information on the management and monitoring of equipment fleets on smartphones. It communicates with the Charlie Platform via secure APIs. The features available to Users via the Mobile Application include equipment management and monitoring, equipment scanning and inventorying, equipment control, and sending emails or alert notifications.

5.4 Charlie Connect application

The purpose of the Charlie Connect Application is to enable the User to geolocate Equipment around them. This application runs in the background on the smartphone and allows the GPS coordinates of surrounding sensors to be reported. No sensitive data concerning the User's identity is reported.

6. Limitations on technical data

6.1 Charlie Solutions website

The website cannot be held liable for any material or immaterial damage related to the use of the website. Furthermore, users of the website agree to access the website using recent, virus-free equipment and an up-to-date, latest-generation browser.

6.2 Services

Although Charlie Solutions has taken all necessary steps to ensure the reliability of the information, services, software, or products contained on the Charlie Platform, it cannot be held liable for any errors, omissions, viruses, or results that may be obtained through misuse of these. Charlie Solutions is only bound by a simple obligation of means.

The User declares and guarantees that they are aware of the characteristics and limitations of the Internet, and in particular that the transmission of data and information over the Internet is only relatively reliable, as it circulates on heterogeneous networks with varying technical characteristics and capacities, which may disrupt access or render it inaccessible at certain times.

Charlie Solutions strives to keep the Site accessible 24 hours a day, 7 days a week, but is under no obligation to do so and therefore provides no guarantee of permanent availability, accessibility, or performance. Charlie Solutions and/or its suppliers may also interrupt access, in particular for reasons of maintenance and upgrading of the Charlie Platform or its hosting infrastructure, or for any other legitimate reason on the part of Charlie Solutions. Charlie Solutions shall in no event be liable for such interruptions and the consequences that may result for the User or any third party.

7. Security

Charlie Solutions strives to ensure the security of its Services in accordance with best practices. However, Users are informed of the risks inherent in electronic communications networks, particularly those related to data transmission over the internet. More generally, it is the User's responsibility to deploy all the usual protections (firewalls, antivirus software, etc.) related to Internet browsing. Consequently, Charlie Solutions provides no guarantee in this regard.

In any event, the User shall strictly refrain from any attempt to reverse engineer or decompile all or part of the Charlie Platform, from any intrusion or attempted fraudulent intrusion into the information system hosting the Charlie Platform and the software enabling its operation, from any breach of trust, misappropriation, deletion, misappropriation, or unauthorized modification of the Site's technical data, under penalty of prosecution.

8. Intellectual property and counterfeiting

Charlie Solutions owns the intellectual property rights or holds the rights to use all elements accessible on the site, including text, images, graphics, logos, icons, sounds, and software.

8. Limitations of Liability

8.1 Charlie Solutions website

Interactive spaces (where users can contact Charlie Solutions teams) are available to users. Charlie Solutions reserves the right to remove, without prior notice, any content posted in this space that contravenes applicable legislation in France, in particular provisions relating to data protection. Where applicable, Charlie Solutions also reserves the right to hold the user liable in civil and/or criminal proceedings, in particular in the event of racist, abusive, defamatory, or pornographic messages, regardless of the medium used (text, photography, etc.).

8.2 Services

The Charlie Platform and any document or content accessible through the Charlie Platform and the Charlie Mobile Application are provided "as is," "as available." Apart from the legal guarantees that cannot be waived, Charlie Solutions makes no warranties, express or implied, of any kind, including in terms of the suitability of the Charlie Platform or the Charlie Mobile Application for a particular use, the availability of the latter, the continuity of its accessibility (the latter may be subject to interruptions of any form and duration), security, the fact that they are free from errors, anomalies, inaccuracies, failures, bugs, or that these can be corrected. These exemptions may be supplemented by more specific provisions within the GTC.

Unless otherwise required by law, Charlie Solutions shall not be held liable for any damage directly or indirectly related to the use of the Charlie Platform or the Charlie Mobile Application due to direct or indirect, material or immaterial damage, including loss of profit, loss of opportunity, loss of customers, loss of data, loss of image, and/or intangible damages suffered by the User.

9. Management of personal data

In France, personal data is protected by Law No. 78-87 of January 6, 1978, Law No. 2004-801 of August 6, 2004, Article L. 226-13 of the Penal Code, and the General Data Protection Regulation (GDPR) of April 27, 2016.

When you use the https://www.charlie-solutions.com website and related Services, Charlie Solutions may collect the following data: the URL of the links through which you accessed the site, your internet service provider, your internet protocol (IP) address, and other information necessary to provide and improve our Services.

9.1 Data collected via the mobile application and the Charlie Platform

When you use the Charlie mobile app and the Charlie Platform, Charlie Solutions may collect and process anonymized usage data to improve its products and services and develop new features that meet user needs. This data may include, but is not limited to, information about the most frequently used features, navigation paths within the app, and interactions with different sections of the platform.

These analyses are carried out in a strictly anonymous manner, without the possibility of personally identifying individual users. The data collected in this way is used solely for research and development purposes, to optimize the user experience and enhance the security and performance of the services offered.

9.2 Purposes of data processing

The personal information collected is used only for the following purposes:

  • Provide the services requested by the User;
  • Improve the quality and efficiency of the services offered;
  • Develop new features and products that meet user needs;
  • Ensure the security of data and services;
  • Comply with legal and regulatory obligations.

9.3 User Rights

In accordance with the provisions of Articles 38 et seq. of Law 78-17 of January 6, 1978, and the GDPR, all users have the right to access, rectify, delete, and object to the processing of their personal data. 9.4 Data sharing

10. Hyperlinks and cookies

Hypertext links may be present on the site. Users are informed that by clicking on these links, they will leave the Charlie Solutions website or the Charlie Platform. Charlie Solutions cannot be held liable or jointly liable for content published and/or hosted on a third-party website to which the Charlie Platform redirects via a hyperlink, or content published and/or hosted on a third-party website that links to the Charlie Platform or the Charlie Solutions website.

Users are informed that when they visit the website, a cookie may be automatically installed on their browser.

Cookies are small files temporarily stored on the hard drive of the User's computer by your browser and are necessary for the use of the https://www.charlie-solutions.com website. Cookies do not contain personal information and cannot be used to identify anyone. A cookie contains a unique identifier, which is randomly generated and therefore anonymous. Some cookies expire at the end of the User's visit, while others remain.
